Eggman bill to increase fresh food donations passes Assembly

SACRAMENTO – A bill by Assemblymember Susan Talamantes Eggman that would make more fresh food available to food banks was passed from the Assembly on Wednesday on a vote of 70 to 0.

Farmers who donate food are eligible for a state tax credit, but are limited to fresh fruits and vegetables and must use a burdensome system to quantify the value of the donation. Eggman’s bill, AB 1577, expands the list of eligible foods to include nuts, beans, dried fruit and meat, among other foods.

It also simplifies the tax credit by making it 10 percent of the donation’s wholesale value, and extends the program’s sunset to 2022.

The bill is supported by both farmers and food banks. A similar bill by Eggman, D-Stockton, offering a credit of 15 percent of a donation’s wholesale value, passed the State Legislature last year, but was vetoed by Gov. Jerry Brown along with several other tax credit bills.

AB 1577 must still pass from the Senate before it reaches the governor’s desk.
